Judge Drops Rape Charge Against Accused Killer Uncle

A judge dismissed the statutory rape charge against David Prevatte in the case involving the death and alleged assault of 5-year-old Paitin Fields, ruling that the evidence was insufficient to support the charge. The judge said the inconclusive third DNA component was not enough to establish that Prevatte sexually assaulted his niece, warning that a jury would otherwise be left to guess. The state objected to the ruling.
